
We’ve previously reported on changes introduced by the FairWork Commission, re the engagement of employees on fixed term employment contracts. Effective 6 December 2023, these rules limited when fixed term contracts could be used, and introduced a cap of 2 years on the length of those contracts.
However, the rules posed challenges for the NFP sector, which has legitimate reasons for using fixed-term contracts over longer periods of time, particularly when the contract term is tied to funding arrangements for the organisation. To reflect these funding realities in the sector, some exemptions to the rules were introduced for NFPs in November 2024 (with conditions applied).
Until recently it was unclear whether these exemptions would continue. We were pleased to see that they have been extended up to 1 Nov 2026 – though with some additional requirements. For more info see the Fairwork website.
