Paid family & domestic violence leave: our approach (where we manage clients’ payroll)

In October 2022, Parliament passed the Fair Work Act Amendment – Paid Family and Domestic Violence Leave.

This provides an entitlement for all employees, including casual employees, to 10 days of paid family and domestic violence leave in each 12-month period.

These changes came into effect on 1 February for larger businesses (with 15 or more employees). For small businesses (with less than 15 employees) these changes will commence 1 August 2023.

The entitlement is available in full at the start of each 12-month period and it is not cumulative from year to year. Super is paid on this leave.

Employers using Xero will see that the system has created a new category for this leave. Due to the sensitive nature of this leave, the approach Purpose is taking for clients where we do the payroll, is to credit the leave as it is used (up to the limit provided by law). Purpose only tracks leave taken (not the leave balances). This is consistent with our approach to other special anniversary leave categories.
